GST Refund: Eligibility, Application Process, Documents and Status

A GST refund allows an eligible taxpayer to recover tax, interest or accumulated input tax credit in the situations permitted under the GST law. Refund claims may arise from exports, supplies made without payment of tax under a Letter of Undertaking, excess tax payment, inverted duty structure or other eligible circumstances.

A refund is not granted automatically. The applicant must identify the correct category, submit the claim within the permitted time and provide documents supporting the amount claimed. The application is examined by the proper officer before the amount is sanctioned.

What is a GST refund?

A GST refund is the return of an eligible amount paid or accumulated under the GST system. The amount may be credited to the applicantโ€™s bank account or recredited to the electronic credit ledger, depending on the nature of the claim and the applicable provisions.

Section 54 of the CGST Act and Rules 89 to 97A of the CGST Rules provide the main framework for refund applications. Specific procedures may also apply to exports, supplies to Special Economic Zones and other notified transactions.

Who can apply for a GST refund?

A registered person, an unregistered person in permitted cases, a specialised agency or another eligible applicant may claim a refund depending on the reason for the claim.

Common applicants include exporters, suppliers to SEZ units or developers, businesses with accumulated input tax credit and taxpayers who have paid tax or other amounts in excess by mistake.

Common situations where a refund may arise

  • Export of goods or services with payment of IGST

  • Export of goods or services under LUT or bond without payment of IGST

  • Supply to an SEZ unit or developer for authorised operations

  • Accumulation of input tax credit because of an inverted duty structure

  • Excess balance in the electronic cash ledger

  • Tax paid under the wrong head or paid in excess

  • Refund arising from an order, provisional assessment or appellate decision

  • Refund available to a specified class of applicants under the GST law

The reason selected in the application must match the actual transaction. A taxpayer should not claim an export refund under the inverted-duty category or use a general excess-payment category when a specific procedure applies.

Time limit for filing a GST refund claim

In many cases, the application must be filed within two years from the relevant date. The relevant date is not identical for every type of refund. It can depend on whether the claim relates to exports, excess payment, a court or appellate order, or accumulated input tax credit.

Because the relevant date differs by category, calculate the deadline carefully and keep evidence showing when the period began. A delayed application may become time-barred unless a specific legal exception applies.

How to apply online

  1. Log in to the official GST Portal.

  2. Open Services, Refunds and Application for Refund.

  3. Select the correct refund category and financial year or tax period.

  4. Enter the amount claimed and the required transaction details.

  5. Upload invoices, statements, declarations and other supporting documents.

  6. Complete the declaration and submit the application electronically.

  7. Save the Application Reference Number generated after submission.

  8. Track the application through the refund status facility.

The exact fields and documents shown on the portal depend on the selected refund category. Review the draft carefully before submitting it because an incorrect category can delay processing.

Important documents

Documents vary according to the reason for the claim. They may include:

  • Tax invoices and export invoices

  • Shipping bills or export documentation

  • Statement of invoices in the prescribed format

  • LUT acknowledgement or bond documents, where applicable

  • Bank realisation or remittance evidence, where required

  • Purchase invoices supporting accumulated input tax credit

  • Calculation of eligible and ineligible credit

  • Declaration relating to unjust enrichment

  • Copy of an order or appellate decision, where applicable

  • Bank account proof and refund-related declarations

Keep the invoice numbers, taxable values, GST amounts and dates consistent in the refund application, accounting records and GST returns.

Refund for exports under LUT

An exporter may supply goods or services without payment of IGST under a valid Letter of Undertaking, subject to the conditions under the GST law. In this method, the exporter generally claims a refund of eligible unutilised input tax credit instead of claiming a refund of IGST paid on export.

The exporter should maintain the LUT acknowledgement, export invoices, shipping or service documents, receipt of export proceeds where applicable and the relevant return data.

Refund under inverted duty structure

An inverted duty structure can arise when the GST rate on inputs is higher than the GST rate on the outward supply. This may lead to accumulation of input tax credit.

The refund is subject to the statutory formula, exclusions and restrictions. Not every balance in the electronic credit ledger qualifies for refund. Businesses should calculate the eligible amount using the prescribed method and retain a clear working paper.

Unjust enrichment

Refund law generally requires the applicant to demonstrate that the tax burden has not been passed on to another person. This principle is known as unjust enrichment.

If the authority concludes that the applicant has recovered the tax from a customer, the amount may be transferred to the Consumer Welfare Fund instead of being paid directly to the applicant, subject to the applicable provisions and exceptions.

Refund processing and bank credit

After receiving the application, the proper officer may examine the documents, issue a deficiency memo or request clarification. If the claim is accepted, an order is issued and the sanctioned amount is processed according to the refund category.

Ensure that the bank account is validated on the GST Portal. An incorrect or unvalidated bank account can delay the credit of the sanctioned refund.

  • Selecting the wrong refund category

  • Filing after the permitted time limit
